(hereinafter: "Service Provider" or "Seller").

1. Presentation of the Webshop and description of transactions that can be carried out through the Webshop

1.1. The Service Provider offers for sale on the Webshop alcoholic beverages (in particular beers, wines, pálinkas and nihonshu), coffee, brewery tour tickets and the related tasting add-on program, and other merchandise products relating to the activities of the Service Provider, sold on a commercial basis by the Service Provider as part of its business activities (hereinafter together: "Products"). The sale and purchase between the Parties is established according to the rules of distance contracts, by means of distance communication.

1.2. In the case of a distance contract, the contract is concluded within the framework of an organized distance sales system, without the simultaneous physical presence of the parties, with the contracting parties exclusively using means of distance communication for the purpose of concluding the contract. Pursuant to this Contract, sales transactions made through the Webshop are concluded electronically, online, i.e. the sale and purchase of the Products takes place online through the Webshop system on the one hand, and via messages sent to your e-mail address as the customer on the other hand. The Sale and Purchase Agreement concluded online is considered an electronic commerce service, which is regulated by Act CVIII of 2001 on certain issues of electronic commerce services and information society services (hereinafter: "Elkertv.").

2. Presentation of the registration and contract process

2.1. Anyone has the opportunity to access the Webshop and, before initiating the conclusion of the Sale and Purchase Agreement, to view the Products, their essential properties, and the information and instructions for using the Products without providing the data necessary for the execution of the sale; however, the execution of the sale is subject to the provision of the data specified in accordance with the terms of this Contract, while certain services are subject to registration in accordance with this Contract or, in the case of a previously registered user, to logging in.

2.2. Before initiating the conclusion of the Sale and Purchase Agreement, you have the opportunity to view a detailed description of the Product by clicking on the image of the selected Product in the Webshop. The Seller is deemed to have performed in conformity with the contract if the Product has more favorable and beneficial properties than those described in the Webshop or in the user manual.

2.3. In the absence of a separate marking, the purchase price indicated next to the Products already includes VAT, but the purchase price of the Products does not include the cost of delivery. The Service Provider has the right to change the purchase price of the Products that can be purchased through the Webshop, provided that the change in the purchase price of a Product shall in all cases take effect simultaneously with its appearance in the Webshop. For the sake of clarity, the Service Provider declares that the modifications do not adversely affect the purchase price of the Products already ordered.

2.4. The purchase prices of the Products are determined by default in euros (EUR). The currency in which prices are displayed in the Webshop and the currency applicable to the purchase are determined by the shipping country selected in the upper right part of the Webshop: if Hungary is selected, the prices determined in euros are displayed in Hungarian forints (HUF) and are also charged in forints during the purchase, while if any other country is selected, the prices are displayed and the sale is made in euros (EUR). The purchase price shown in forints is converted from the purchase price determined in euros by the Shopify platform operating the Webshop, on the basis of the market exchange rate published by XE.com and updated by the platform twice a day (at 00:00 and 07:00 GMT); the update may appear in the Webshop with a delay of a few hours, therefore the purchase price shown in forints may change daily. The current exchange rate applied to the prices expressed in forints is shown on the Cart page under "Exchange rate". The purchase price payable by you is the amount and currency shown on the Checkout page at the time the order is submitted, which is not affected by any change in the exchange rate after the order is submitted. If your payment account is held in a currency other than the currency of the purchase price, the Service Provider is not responsible for the exchange rate and conversion fee applied by your bank.

2.5. If, despite all the care taken by the Service Provider, the price of a Product is displayed incorrectly in the Webshop, including obviously incorrect prices, e.g. prices significantly different from the well-known, generally accepted or estimated price of the product (strikingly disproportionate), as well as prices of "0" HUF or "1" HUF or of "0" EUR or "1" EUR appearing due to a system error, the Service Provider is not obliged to deliver the Product at the incorrect price, but may offer delivery at the correct price, in the knowledge of which you may cancel your purchase without any obligation to provide reasons.

2.6. If you wish to purchase a Product, you can do so in several ways. A maximum of 12 units of any given Product may be placed in the Cart per order; if you wish to order a larger quantity, please contact the Service Provider in advance at webshop@gravity.shop.

2.6.1. On the one hand, without opening the Product data sheet, you can initiate placing the Product in a virtual cart by clicking on the cart icon in the bottom right corner of the given Product; in this case, you can place the Product(s) in the cart by entering the desired quantity in the panel appearing on the right side of the Webshop and clicking on the "Add to cart" button.

2.6.2. Alternatively, you can place a Product in the virtual cart by clicking on the Product data sheet and then entering the desired quantity and clicking on the "Add to cart" button.

2.7. Whichever method you use to initiate the purchase of the Product(s), the Webshop confirms the placing of the Product(s) in the Cart in a pop-up window appearing in the upper right corner of the page, where you can view the Cart by clicking on the "View cart" button, or return to shopping by clicking on the "Continue shopping" button below it. If you choose neither option, the pop-up window disappears after 10 seconds and you can continue shopping.

2.8. In addition to continuing shopping, you can open the "Shopping Cart" page by clicking on the cart icon in the upper right corner of the Webshop, where you can modify the quantity of the Products or delete Products, and then proceed to the Checkout ("Pénztár") page by clicking on the "Check out" button. In the "Shipping" section of the Checkout page, you can choose whether you would like the Product(s) to be delivered to your address ("DPD - Home Delivery") or to collect them in person at the Gravity Taproom ("Pick up in Gravity Brewing Taproom"). In the case of home delivery, please provide the name of the recipient and the delivery address in the required detail. If you wish to have the Product(s) delivered to a parcel locker, you must select the parcel locker on the "Shopping Cart" page, before clicking on the "Check out" button; section 4.11 shall apply in this respect.

2.9. You can also pay by clicking on the Shop Pay, PayPal or Google Pay button in the "Express checkout" section at the top of the Checkout page; in this case, the contact, delivery and billing details may also be filled in based on the data stored by you with the respective provider. The provisions of this Contract, in particular Chapter 5, shall also apply to the use of the Express checkout.

2.10. If you do not wish to have the Product(s) delivered to your address, you can indicate that you would prefer to collect the Product(s) in person at the Gravity Taproom by selecting the "Pick up in Gravity Brewing Taproom" shipping method on the Checkout page.

2.11. After clicking on the "Check out" button on the "Shopping Cart" page, you have the opportunity to enter the data required for invoicing, select the payment terms and change the delivery terms in accordance with the terms of this Contract. If you have a coupon code, you can claim the coupon discount by entering it in the "Discount code" field displayed after clicking on "Add discount" (which will be activated after clicking on the "Apply" button), and select the delivery method. Once the delivery method is selected, the delivery cost will be added to the purchase price. When the delivery method is selected, the Checkout page shows the available delivery methods, their fees and the expected delivery date; the conditions of delivery are set out in Chapter 4.

2.12. If you have previously registered in the Webshop, you can log in by clicking on the profile icon in the header of the Webshop or on the "Log in" link on the Checkout page, either by filling in the "E-mail address" field and entering the one-time verification code sent to the e-mail address you provided during registration, or with your Shop account by clicking on the "Continue with Shop" button; in the latter case, if Shop does not recognize your device, it may also request a verification code sent by SMS to the phone number associated with your Shop account. If you wish to register as a new customer, please enter the customer data requested by the Webshop during the registration process, which will be stored by the Webshop, and you will only need to log in the next time you make a purchase. For purchases without registration, please enter your billing and shipping address.

2.13. If you have not previously registered as a user of the Webshop, you can do so by clicking on the profile icon in the header of the Webshop, entering your e-mail address and the verification code sent to it, or, before placing the final order for the selected Products, by clicking on the "Log in" link on the Checkout page. To register, you will be required to provide a real e-mail address to which you have access and which you are entitled to use.

2.14. After you enter the verification code, the registration is created, and the Webshop sends a confirmation message to the e-mail address provided.

2.15. The Service Provider excludes its liability for any failure of registration due to incorrect or inaccurate data provided by you, or for any delay or other damage caused by incorrect delivery data provided by you during the ordering process – with the exception of liability for breach of contract committed intentionally or by gross negligence, or causing damage to life, physical integrity or health. Furthermore, the Service Provider shall not be liable for any damages resulting from your e-mail account or the verification code sent for logging in becoming accessible to unauthorized persons for any reason not attributable to the Service Provider.

2.16. After logging in to the Webshop, you can change the previously recorded registration data in the "Profile" menu of the account page opened by clicking on the profile icon in the header of the Webshop (in mobile view, on the "Account" item of the menu): you can change your name with the "Edit" button, your delivery addresses in the "Addresses" section, and your consent to the newsletter in the "Marketing preferences" section. The Service Provider excludes any liability for any damage caused by the inadequacy or lack of adequacy of the data changes made by you. Keeping your registration details up to date is your responsibility and risk.

2.17. In the "Orders" menu of the account page, you can view your previous orders and their payment and fulfillment status, and place previously ordered Products in the Cart again with the "Buy again" button.

2.18. You have the right to delete your registration in the Webshop at any time if you do not have an active order in progress – i.e. if there is no Sale and Purchase Agreement concluded through the Webshop that has not yet been performed by the Service Provider. There is no separate button for deleting the registration on the account page; you can request the deletion through any of the Service Provider's contact details, in particular at the e-mail address webshop@gravity.shop. The Service Provider shall comply with the request without undue delay, but no later than within one month of its receipt, and shall notify you thereof by e-mail, provided that the data and documents related to previous Sale and Purchase Agreement already performed will be retained in accordance with this Contract and the applicable legal provisions. Once the registration is deleted, it is no longer possible to restore the data.

2.19. During the process of concluding the Sale and Purchase Agreement, after selecting the delivery method on the Checkout page (personal pickup at the Gravity Taproom, home delivery by DPD – which is the only delivery method available if a shipping country other than Hungary is selected) or – if you have already selected the pickup point on the Cart page – delivery to the parcel locker, select the payment method (bank card or PayPal) in the "Payment" section on the same page, and then click on the "Tovább az összesítésre" button. If you wish to use the MPL delivery service provided by Magyar Posta Zrt., please proceed as described in section 4.4.

2.20. After that, by clicking on the "Tovább az összesítésre" button, you can view the order details in full ("Complete order" page). If the data is not correct, you can click on the "Modify" option of each menu item to correct it, which will take you back to the page where you can modify the data. If all data is correct, you can finalize the order with the button at the bottom of the page. A further condition for the conclusion of the Sale and Purchase Agreement is that, on the Cart page, before clicking on the "Check out" button, by ticking the relevant checkboxes, you accept this Contract – which is also accessible via the links on the Cart page, at the bottom of the Checkout page and in the footer of the Webshop –, acknowledge the privacy notice, and declare that you have reached the age of 18; without ticking these checkboxes, you cannot proceed to the Checkout page. If you wish to finalize your order, you can do so by clicking on the "Pay now" button. If you choose PayPal, you can submit the order by clicking on the button labeled PayPal, which also redirects you to the PayPal payment page.

3. Binding offer, conclusion of the Sale and Purchase Agreement

3.1. By clicking the "Pay now" button, you make an offer to the Service Provider to conclude a Sale and Purchase Agreement for the Products (hereinafter: "Offer"), which, if accepted by the Service Provider, obliges you to pay the purchase price of the Product(s), while the Service Provider will be obliged, in accordance with this Contract and the terms of the Sale and Purchase Agreement, to transfer the ownership and possession of the Product(s) (order with obligation to pay). Therefore, clicking on the "Pay now" button does not automatically create a Sale and Purchase Agreement between the Service Provider and you; however, in accordance with the provisions of this Contract, by clicking on the "Pay now" button you make a binding Offer for the purchase of the Products selected and ordered from the Service Provider, and if the Offer is accepted by the Service Provider, the payment of the purchase price of the Products may be enforced against you in accordance with the rules on binding offers.

3.2. The Service Provider will confirm the acceptance of the Offer to you via automatic e-mail within 48 hours at the latest, and the Sale and Purchase Agreement will be concluded upon the delivery of the e-mail confirming the acceptance to your e-mail address. The e-mail accepting the Offer contains the customer data provided by you, the order identifier, the date of the order, the list and quantity of the items belonging to the purchased Product, the price of the Product, the shipping costs and the total amount payable (hereinafter: "Purchase Price").

3.3. If the Service Provider does not send you an e-mail confirming the acceptance of the Offer within 48 hours of the submission of the Offer at the latest, you will no longer be bound by the Offer, and the sale of the Product(s) will not take place.

3.4. If, after the submission of the Offer or in the e-mail confirming the acceptance of the Offer, you notice that there is an error in the data provided or confirmed, you are entitled to notify the Service Provider thereof by e-mail or even by telephone until the performance of the Sale and Purchase Agreement.

3.5. If the Product to be purchased is not available in the Webshop at the time the Offer is sent, or if a specific Product is ordered by the Service Provider from the supplier only by special order, and this circumstance is clearly indicated on the Product data sheet in the Webshop, the Service Provider reserves the right not to accept the Offer, in which case no Sale and Purchase Agreement will be concluded between the Parties. The Service Provider will notify you by e-mail of the refusal to accept the Offer, and if payment has already been made, the Service Provider will immediately refund the amount you have already paid by bank transfer.

3.6. A contract concluded between the Parties in English for the purchase of goods as an electronic contract is considered a written contract; the Service Provider files it and keeps it for 5 years after its conclusion, and it is accessible afterwards. The resulting Sale and Purchase Agreement is governed by Act V of 2013 on the Civil Code and Act CVIII of 2001 on certain issues of electronic commerce services and information society services. If you qualify as a consumer, the contract falls under the scope of Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, and takes into account the provisions of Directive 2011/83/EU of the European Parliament and of the Council on consumer rights.

4. Conditions related to delivery

4.1. The Service Provider will deliver the purchased Products into your possession at the address provided by you on the Checkout page in the process of concluding the Sale and Purchase Agreement, at your choice, within the territory of Hungary by DPD Hungary Kft. by home delivery or by delivery to a parcel locker, or by FoxPost Kft. by delivery to a parcel locker, and, if a shipping country other than Hungary is selected, exclusively by DPD Hungary Kft. by home delivery (the service providers performing the delivery hereinafter together: "Courier"; the delivery hereinafter together: "Courier Delivery"), or, exclusively within the territory of Hungary, by using the postal service for the home delivery of parcels provided under the name MPL by Magyar Posta Zrt. as a postal service provider (hereinafter: "Post") (hereinafter: "Postal Delivery"), in accordance with section 4.4, or, if personal pickup is chosen, at the Gravity Taproom located in the basement of 1093 Budapest, Lónyay utca 22.

4.2. If you choose Courier Delivery or Postal Delivery, you will bear the costs thereof; the passing of risk shall be governed by section 4.10. The Service Provider will inform you about the costs and conditions of delivery and the available delivery methods during the process of concluding the Sale and Purchase Agreement. The Service Provider is entitled to determine the conditions and fees unilaterally; the amendments will enter into force at the same time as they are published in the Webshop, and will therefore not affect Offers already accepted before publication.

4.3. Shipping costs are determined by taking into account the Products in the "Shopping Cart". Both the Post and the Courier are entitled to apply different delivery fees for different product categories (including, but not limited to: large packages, small packages).

4.4. For information on the current delivery charges set by the Post in its General Terms and Conditions for Postal Services (https://www.posta.hu/general_terms_and_conditions), please visit the website of the Post; please note that in the case of Postal Delivery, the Service Provider charges an administrative lump-sum fee of HUF 3,000 per order. If you wish to have the Products you have purchased delivered by Postal Delivery, please contact the Service Provider at the e-mail address postaldelivery@gravity.shop before submitting your order, and the Service Provider will inform you of all necessary details, including the costs.

4.5. Information on the fees for Courier Delivery is available on the Checkout page when selecting the delivery method, while the general terms and conditions of Courier Delivery can be viewed on the website of the selected Courier (in the case of DPD: https://www.dpd.com/hu/en/hu-gtc/; in the case of Foxpost: https://foxpost.hu/en/general-terms-and-conditions). You must bear the shipping cost of the Products you have purchased; this amount will be shown on the summary screen during the process of concluding the Sale and Purchase Agreement, as well as on the invoice and in the e-mail confirming the acceptance of the Offer. You have the opportunity to agree on the date of delivery with the Service Provider at the phone number provided in the e-mail confirming the acceptance of the Offer and, after the delivery process has started, directly through the customer service channels of the Courier.

4.6. On the date of entry into force of this Contract, the delivery fees are as follows: personal pickup at the Gravity Taproom: free of charge; delivery to a Foxpost parcel locker: HUF 1,000 (gross); the fees for delivery to a DPD parcel locker and DPD home delivery are set out in the table on the https://gravity.shop/pages/shipping page. In addition to the delivery method, the Checkout page also shows the expected delivery date.

4.7. In the absence of a different agreement, the Service Provider is obliged to make the purchased Product available to you without delay, but no later than thirty days after the conclusion of the Sale and Purchase Agreement. In case of delay by the Service Provider, you are entitled to set an additional deadline. If the Service Provider does not perform within the additional deadline, you become entitled to withdraw from the contract.

4.8. If, according to the agreement of the Parties or due to the recognizable purpose of the service, the Sale and Purchase Agreement should have been performed at a specified time – and not at any other time –, or if you informed the Service Provider before the conclusion of the contract that performance at the specified time is essential for you, you are entitled to withdraw from the Sale and Purchase Agreement without setting an additional deadline. In this case, the Service Provider shall refund the total amount paid by you, including the costs incurred in connection with the performance, without delay, but no later than within fourteen days of becoming aware of the withdrawal.

4.9. In the case of personal pickup, the purchased Product(s) may be collected at the Gravity Taproom located in the basement of 1093 Budapest, Lónyay utca 22. during the opening hours of the Gravity Taproom displayed in the Webshop, from the day indicated for pickup on the Checkout page. For the pickup, you will need the order identifier indicated in the e-mail accepting and confirming the Offer. Personal pickup is free of charge.

4.10. If you qualify as a Consumer, the risk of loss related to the Product passes to you when you or a third party designated by you takes possession of the Product; the Service Provider is therefore liable to you for the loss, destruction or damage of the Product during delivery. If you engaged the carrier and the carrier was not recommended by the Service Provider, the risk passes to you upon handover of the Product to the carrier. If you do not qualify as a Consumer, the risk passes to you upon handover of the Product to the Courier or the Post. Please check the integrity of the shipment upon receipt and, in the case of a damaged shipment, ask the courier to draw up a report; failure to do so does not affect the rights of the Consumer.

4.11. If you request delivery to a parcel locker, you can select the parcel locker before clicking on the "Check out" button, on the map that appears on the "Shopping Cart" page when clicking on the "Pickup points" button, from among the parcel lockers of DPD and Foxpost. In this case, the address of the selected parcel locker appears as the delivery address on the Checkout page, and delivery to the parcel locker ("Foxpost & Packeta - Pickup Point" for a Foxpost parcel locker and "DPD - Pickup point" for a DPD parcel locker) can be selected as the shipping method. You can change the selected parcel locker on the Cart page with the pencil icon or delete it with the trash icon. If you do not select a parcel locker on the Cart page, home delivery or personal pickup can be selected on the Checkout page. If a shipping country other than Hungary is selected, delivery to a parcel locker cannot be selected; only home delivery by DPD is available.

4.12. The Service Provider sells alcoholic products exclusively to persons who have reached the age of 18. Upon handover of a shipment containing an alcoholic product, the Courier, the Post or, in the case of personal pickup, the Service Provider is entitled – in case of doubt – to request credible proof of the recipient's age, and in the absence thereof refuses to hand over the shipment. In the case of delivery of a shipment containing an alcoholic product to a parcel locker, only you or a person authorized by you who has reached the age of 18 is entitled to collect the shipment; you may not give the code required to collect the shipment to a person under the age of 18.

4.13. The Service Provider does not offer any separate environmentally friendly delivery option in the Webshop, in particular delivery by cargo bike or electric delivery vehicle, or the consolidated delivery of orders. The available delivery methods are set out in section 4.1 and the related delivery fees in section 4.6; the Products may also be collected in person at the Gravity Taproom without using any delivery service (section 4.9). Should the Service Provider introduce an environmentally friendly delivery option in the future, it will inform you thereof on the “Shipping” page of the Webshop and on the Checkout page when you select the delivery method..

5. Conditions related to payment

5.1. You can select the payment method during the process of concluding the Sale and Purchase Agreement. During the purchase process, under the "Payment" tab, you can select the payment method: (i) bank card payment ("Credit card") or (ii) PayPal, and, in the "Express checkout" section at the top of the Checkout page, (iii) Shop Pay, (iv) PayPal or (v) Google Pay. Cash on delivery and bank transfer are not available.

5.2. The payment process starts on the Checkout page, after selecting the payment method and reviewing the order summary ("Complete order" page), upon clicking on the "Pay now" button (order with obligation to pay).

5.3. Bank card payments – including payments made with Shop Pay and Google Pay in the Express checkout – are processed within the framework of the Shopify Payments service by Shopify International Limited (The Sidings, 4th Floor, Grand Canal Quay, Dublin D02 E7K8, Ireland) and the payment service provider engaged by it. You must enter your bank card details on the Checkout page, on Shopify's encrypted payment interface; the Service Provider has no access to them. The accepted card types are indicated on the Checkout page at the "Credit card" payment method.

5.4. If you choose PayPal, you will be redirected to the payment page of PayPal (Europe) S.à r.l. et Cie, S.C.A. (https://www.paypal.com/pay/), where you can pay with your PayPal account or by any other method offered there. If you select the "Save my information for faster checkout” option on the Checkout page, a Shop account will be created by providing your phone number, to which Shop's own terms of service and privacy policy apply. You will be notified of the result of the payment by e-mail.

5.5. The terms and conditions of the respective provider shall also apply to the use of the payment services: Shopify Payments: https://www.shopify.com/legal/terms-payments/hu; Shop Pay: https://shop.app/terms-of-service; PayPal: https://www.paypal.com/hu/legalhub/paypal/home?locale.x=hu_HU.

5.6. The Service Provider issues an invoice for the sale of Products in accordance with Act CXXVII of 2007 on Value Added Tax (hereinafter: "VAT Act"). The invoice issued by the Service Provider is an accounting document that is fully suitable for identification for tax administration purposes as regulated by accounting and tax legislation. The Service Provider issues the invoice with the Számlázz.hu invoicing software as an electronic invoice, i.e. as an invoice issued and received in electronic form, after performance, within the deadline prescribed by the VAT Act. By accepting this Contract, you expressly consent to the Service Provider issuing the invoice as an electronic invoice and sending it [from the Számlázz.hu system] to the e-mail address provided during the conclusion of the Sale and Purchase Agreement; the invoice can also be downloaded [via the link received in the e-mail]. If you do not consent to receiving an electronic invoice, please indicate this at webshop@gravity.shop at the same time as submitting your order; in this case, the Service Provider will issue the invoice in paper form and hand it over together with the Product or send it by post.

5.7. On the invoice issued by the Service Provider, the Purchase Price of the Product or Products, the method of payment and the payment deadline will be indicated in the case of any Sale concluded online. The Service Provider issues an invoice for the ordered and delivered products (including services) in accordance with the applicable legislation. It is the sole responsibility of the company represented by you to record all relevant data for the invoice to be issued in accordance with reality, including any typos. If incorrect or incomplete data is provided, the Service Provider will amend the invoice at your request in accordance with the applicable legislation. The Service Provider excludes its liability for damages arising from an invoice that is not suitable for exercising the right to deduct tax as a result of the provision of incorrect, incomplete or erroneous data, and all such damages shall be borne by the company represented by you.

6. Right of withdrawal

6.1. The provisions of this Chapter apply exclusively to natural persons acting outside the scope of their profession, independent occupation or business activity who buy, order, receive, use or make use of goods, or who are the addressees of commercial communications or offers related to goods (hereinafter: "Consumer"). If you qualify as a Consumer, in the case of a contract for the sale of products, you are entitled to withdraw from the contract without giving reasons within fourteen (14) days from the date on which you or a third party designated by you, other than the carrier, takes possession of

(i) the Product;

(ii) in the case of the supply of several Products, the last Product supplied;

(iii) in the case of a Product consisting of several items or pieces, the last item or piece supplied;

(iv) if the Product must be supplied regularly within a specified period, the first supply.

6.2. If you qualify as a Consumer, you are also entitled to exercise your right of withdrawal in the period between the day of the conclusion of the Sale and Purchase Agreement and the day of receipt of the Product. In the case of a contract for the provision of services, the Consumer may exercise the right of withdrawal within fourteen days from the date of conclusion of the contract.

6.3. The Consumer is not entitled to the right of withdrawal

  • in the case of a non-prefabricated product that was produced on the basis of the Consumer's instructions or at the Consumer's express request, or in the case of a product that was clearly personalized for the Consumer;
  • with regard to a sealed Product that cannot be returned after being unsealed following delivery for reasons of health protection or hygiene;
  • in the case of a contract for services related to leisure activities – in particular a brewery tour ticket – if the contract provides for a specific date or period of performance;
  • with regard to digital content supplied on a non-tangible medium, if the Service Provider has started the performance with your express prior consent and you have, at the same time as giving your consent, acknowledged that you will lose your right of withdrawal once performance has started.

6.4. If you, as a Consumer, wish to exercise your right of withdrawal, you can do so by sending a statement addressed to the Service Provider expressly and clearly stating your intention to withdraw to any of the Service Provider's contact details specified in this Contract (by post or e-mail). For this purpose, the Consumer may also use the model withdrawal form attached to the order confirmation e-mail or set out in Annex 2 to Government Decree 45/2014 (II. 26.) on the detailed rules of contracts between consumers and businesses, or downloadable in PDF format from the "Withdrawal from the contract" page of the Webshop. You can also exercise your right of withdrawal in the Webshop, on the page that opens when clicking on the "Withdrawal from the contract" link in the footer of the Webshop, by using the withdrawal function labeled "Withdrawal from the contract": in the online statement, you must indicate your decision to withdraw, your name, the data identifying the contract (in particular the order identifier) and the electronic contact details to which you request the confirmation of the withdrawal, and you can then send the statement with the button labeled "Confirm withdrawal". After becoming aware of the withdrawal, the Service Provider shall send you, without undue delay, an acknowledgment of receipt on a durable medium (by e-mail) containing the content of the withdrawal and the date and time of its submission.

6.5. The Consumer exercises the right of withdrawal in due time if the Consumer sends the withdrawal statement to the Service Provider by e-mail before the expiry of the 14-calendar-day deadline indicated above. In the case of withdrawal in writing, it shall be deemed to have been exercised in due time if the Consumer sends the statement to that effect to the Service Provider within 14 calendar days (even on the 14th calendar day); i.e. in the case of withdrawal by post, the Service Provider takes into account the date of posting, and in the case of withdrawal by e-mail or through the withdrawal function of the Webshop, the time of sending the statement for the purpose of calculating the deadline. You can also send the withdrawal statement to the Service Provider by registered mail, so that the date of dispatch can be credibly proven.

6.6. The Service Provider shall confirm the receipt of the Consumer's withdrawal statement without delay by sending a message to the e-mail address provided during the process of concluding the Sale and Purchase Agreement.

6.7. If you have exercised your right of withdrawal from the Sale and Purchase Agreement in accordance with this Chapter, you must return the purchased Product at your own expense to the registered office of the Service Provider specified in this Contract without undue delay, but no later than within 14 days from the date of communicating your withdrawal statement. The deadline for returning the Product is deemed to have been met if you send the purchased Product (post it or hand it over to the courier ordered by you) before the 14-day deadline has expired.

6.8. The Service Provider shall refund the total amount paid by you as consideration, including the delivery fee, without delay, but no later than within 14 days from the date of receipt of the Consumer's withdrawal statement, with the exception of the additional costs incurred as a result of the Consumer choosing a mode of transport other than the least expensive standard mode of transport offered by the Service Provider. The Service Provider has the right to withhold the refund until it has received the Product back or the Consumer has credibly proven that it has been returned, whichever is earlier.

6.9. When refunding the Purchase Price, the Service Provider shall use the same payment method as the one used in the Sale, unless the Consumer expressly consents to the use of another payment method; the Consumer shall not incur any additional costs as a result of the use of this refund method. The Service Provider shall refund the Purchase Price in the same currency and in the same amount in which you paid it; you shall not bear any change in the exchange rate in the meantime or any conversion fee charged by the payment service provider.

6.10. If the value of the returned Product has decreased due to use beyond what is necessary to establish the nature and characteristics of the Product, the Consumer is obliged to compensate the Service Provider for it. The burden of proving this lies with the Service Provider.

6.11. In the case of withdrawal under this Chapter, you, as the Consumer, bear the burden of proving that you exercised your right of withdrawal in accordance with this Chapter and the provisions of Government Decree 45/2014 (II. 26.).

7. Warranty

7.1. Warranty for defects (kellékszavatosság)

7.1.1. If the Service Provider performs defectively, you may assert a warranty claim for defects against the Service Provider, provided that you must notify the Service Provider of the defect without delay after discovering it. If you qualify as a Consumer, a defect notified within two months of its discovery shall be deemed to have been notified without delay.

7.1.2. In the case of a person who does not qualify as a Consumer, warranty claims for defects become time-barred within 1 year from the date of performance of the Sale and Purchase Agreement — i.e. from the time when the Service Provider handed over the Product to you —, and within 2 years in the case of a customer who qualifies as a Consumer; i.e. warranty claims for defects may be asserted against the Service Provider during this period.

7.1.3. Based on the warranty for defects, within the limitation period, the Service Provider is liable to you if the Product does not meet the quality requirements specified in the Product description or established in the Sale and Purchase Agreement or by law. Only claims related to Product defects that already existed at the time the Product was handed over may be asserted. If you qualify as a Consumer, it shall be presumed, until the contrary is proven, that a defect recognized by you within one year of performance already existed at the time of performance, unless this presumption is incompatible with the nature of the goods or the nature of the defect. In the case of a consumer contract, within one year from the date of performance it is therefore sufficient for asserting a warranty claim for defects if you prove that you purchased the Product from the Service Provider (by presenting the invoice or a copy of the invoice).

7.1.4. Based on the warranty for defects, you may – at your choice – request

(a) repair or

(b) replacement,

unless fulfilling the chosen warranty right is impossible or would result in disproportionate additional costs for the Service Provider compared to fulfilling another warranty claim, taking into account the value of the Product in a defect-free condition, the gravity of the breach of contract and the harm caused to you by fulfilling the warranty right, or

(c) you may request a proportionate reduction of the Purchase Price, or

(d) you may repair the defect yourself or have it repaired by someone else at the expense of the obligor, unless you qualify as a Consumer, or

(e) you may withdraw from the Sale and Purchase Agreement, provided that the Service Provider has not undertaken to repair or replace the Product, or is unable to fulfill this obligation within an appropriate time limit, taking into account the characteristics of the Product and the purpose you may expect, while protecting your interests. There is no room for withdrawal due to an insignificant defect. If you qualify as a Consumer, the burden of proving that the defect is insignificant lies with the Service Provider.

7.1.5. You are entitled to switch from the warranty right you have chosen to another one; however, you must pay the Service Provider the costs caused by the switch, unless the Service Provider gave cause for the switch or the switch was otherwise justified.

7.1.6. The limitation period of the warranty claim for defects starts anew for the part of the Product affected by the replacement or repair. This rule shall also apply if a new defect arises as a result of the repair.

7.1.7. The warranty claim for defects shall be deemed asserted in due time for all defects of the Product that caused the indicated defect; however, if you assert your warranty claim with respect to a part of the Product that is separable from the point of view of the indicated defect, the warranty claim shall not be deemed asserted for other parts of the Product.

7.2. Product warranty

7.2.1. If you qualify as a Consumer, in the event of a defect in the Product, you may demand from the Service Provider that it repair the defect of the Product or – if repair is not possible within an appropriate time limit without harming your interests – replace the Product. The Product is defective if it does not meet the quality requirements in force when the Product was placed on the market, or if it does not have the properties listed in the Product description in the Webshop.

7.2.2. The Service Provider is exempt from the product warranty obligation if it proves that

(a) it did not manufacture or place the Product on the market in the course of its business activity;

(b) at the time the Product was placed on the market, the defect was not detectable according to the state of science and technology; or

(c) the defect of the Product was caused by the application of legislation or mandatory regulatory requirements.

7.2.3. You, as a Consumer, are obliged to notify the Service Provider of the defect without delay after discovering it. A defect notified within two months of its discovery shall be deemed to have been notified without delay. You are solely responsible for any damage resulting from a delay in notification.

7.2.4. The Service Provider is liable under the product warranty for two years from the date on which it placed the given Product on the market. Failure to meet this deadline results in the loss of rights. In the event of a transfer of ownership of the Product, the product warranty rights may be asserted against the Service Provider by the new owner. You may assert a warranty claim for defects against the Service Provider and a product warranty claim against the manufacturer for the same defect simultaneously, in parallel. If you successfully assert your product warranty claim, you may assert your warranty claim for defects regarding the replaced Product or the repaired part of the Product only against the manufacturer.

8. Guarantee

8.1. Mandatory guarantee

8.1.1. With regard to its Products, the Service Provider is subject to a guarantee obligation pursuant to the Civil Code and Government Decree 151/2003 (IX. 22.) on the mandatory guarantee for certain consumer durables, i.e. during the guarantee period, it is exempted from liability only if it proves that the cause of the defect arose after performance. The mandatory guarantee applies only to Consumers and only to new products sold within the framework of a consumer contract concluded in Hungary and listed in the annex to the decree.

8.1.2. The guarantee period starts with the actual performance, i.e. the handing over of the Product to you, or, if the Product is put into operation by the Service Provider or its agent, on the day of putting into operation. If you have the Product put into operation more than six months after handover, the guarantee period begins on the day the Product is handed over. Consumer durables are the products listed in the annex to the decree on the mandatory guarantee for certain consumer durables. The guarantee period depends on the selling price of the Product as follows:

(i) two years in the case of a selling price of at least HUF 10,000 but not exceeding HUF 250,000,

(ii) three years in the case of a selling price exceeding HUF 250,000.

8.1.3. A defect is not covered by the guarantee if its cause arose after the Product was handed over to the Consumer, for example if the defect is caused by:

(i) improper putting into operation (unless it was carried out by the Service Provider or its agent, or if the improper putting into operation is attributable to an error in the instructions for use and handling),

(ii) use contrary to the intended purpose, disregarding the instructions for use and handling,

(iii) improper storage, improper handling, damage,

(iv) elemental damage or natural disaster.

8.1.4. In the event of a defect covered by the guarantee, you, as a Consumer,

(i) primarily – at your choice – may demand

a. repair or

b. replacement,

unless fulfilling the chosen guarantee claim is impossible or would result in disproportionate additional costs for the Service Provider compared to fulfilling the other guarantee claim, taking into account the value of the Product in a defect-free condition, the gravity of the breach of contract and the harm caused to you by fulfilling the guarantee claim;

(ii) if the Service Provider has not undertaken the repair or replacement, or is unable to fulfill this obligation within an appropriate time limit while protecting your interests as a Consumer, or if your interest in the repair or replacement has ceased, you may – at your choice –

a. request a proportionate reduction of the purchase price,

b. at the expense of the Service Provider

i. repair the defect yourself, or

ii. have it repaired by someone else, or

c. withdraw from the contract, provided that there is no room for withdrawal due to an insignificant defect.

8.1.5. If you, as a Consumer, assert a replacement claim within three working days of the purchase (putting into operation) due to a malfunction of the Product, the Service Provider may not invoke disproportionate additional costs and is obliged to replace the Product within eight days, provided that the malfunction prevents the intended use. If replacement of the Product is not possible, the Service Provider shall refund the purchase price to you without delay.

8.1.6. The repair or replacement must be carried out within an appropriate time limit, taking into account the characteristics of the Product and the purpose you may expect, while protecting your interests. The Service Provider shall endeavor to carry out the repair or replacement within fifteen days at most.

8.1.7. During the repair, only new parts may be installed in the Product.

8.1.8. If the Product is repaired, the guarantee period is extended, from the date of handover for repair, by the period during which you could not use the Product as intended due to the defect.

8.1.9. If, during the first repair of the Product within the guarantee period specified in the decree on the mandatory guarantee, the Service Provider determines that the Product cannot be repaired, the Service Provider is obliged to replace the Product within eight days, unless you instruct otherwise. If replacement of the Product is not possible, the Service Provider is obliged to refund to you within eight days the purchase price indicated on the document proving payment of the consideration for the Product presented by you – the invoice or receipt issued on the basis of the Act on Value Added Tax.

8.1.10. If, during the guarantee period specified in the decree on the mandatory guarantee, the Product fails again after having been repaired three times – unless you instruct otherwise –, and if you do not request a proportionate reduction of the Purchase Price pursuant to Section 6:159(2)(b) of Act V of 2013 on the Civil Code, and you do not wish to repair the Product or have it repaired by someone else at the expense of the Service Provider, the Service Provider is obliged to replace the Product within eight days. If replacement of the Product is not possible, the Service Provider is obliged to refund to you within eight days the Purchase Price indicated on the document proving payment of the consideration for the Product presented by you – the invoice or receipt issued on the basis of the Act on Value Added Tax.

8.1.11. If the Product is not repaired within thirty days from the notification of the repair request to the Service Provider, the Service Provider is obliged – unless you instruct otherwise – to replace the Product within eight days after the unsuccessful expiry of the thirty-day deadline. If replacement of the Product is not possible, the Service Provider is obliged to refund to you the purchase price indicated on the document proving payment of the consideration for the Product presented by you – the invoice or receipt issued on the basis of the Act on Value Added Tax – within eight days after the unsuccessful expiry of the thirty-day repair deadline.

8.1.12. The costs related to the fulfillment of the guarantee obligation shall be borne by the Service Provider.

8.1.13. The guarantee does not affect the enforcement of the Consumer's statutory rights – in particular warranty rights for defects, product warranty rights and rights to compensation –, and you may assert a warranty claim for defects and a guarantee claim, as well as a product warranty claim and a guarantee claim, simultaneously, in parallel, for the same defect; however, once you have successfully asserted a claim for a given defect, you may not assert a claim for the same defect on another legal basis. You are entitled to the rights arising from the guarantee irrespective of the rights defined in the provisions of this Contract governing the warranty for defects and the product warranty.

8.2. Voluntary guarantee

8.2.1. The Service Provider may undertake a guarantee for the products it sells for the period indicated in the Product description in the Webshop, which may be longer than the period under the decree. The Service Provider shall communicate the duration of the guarantee for each Product by means of the data on the guarantee card provided at the latest upon handover of the Product.

9. Limitation of Liability

9.1. You may use the Webshop solely at your own risk, and you accept that the Service Provider shall not be liable for material or non-material damage arising during use, beyond its liability for breach of contract committed intentionally, by gross negligence or by a criminal offense, or causing damage to life, physical integrity or health.

9.2. Data and information related to the Products offered for sale on the Webshop and to the services provided to you by the Service Provider have been posted in good faith; however, they are for informational purposes only, and the Service Provider does not assume responsibility for the accuracy or completeness of the information.

9.3. The Service Provider excludes liability for the conduct of the users of the Webshop. You are fully and exclusively responsible for your own conduct; in such cases, the Service Provider will fully cooperate with the competent authorities in order to detect infringements.

9.4. If you notice objectionable content in the Webshop, you must report it to the Service Provider immediately. If, in the course of its good faith procedure, the Service Provider finds the indication to be well-founded, it is entitled to immediately delete or modify the information.

10. Contract language, governing law, dispute resolution

10.5. Pursuant to the applicable legislation, the Service Provider shall immediately investigate an oral complaint (made in a store) and remedy it as necessary, if the nature of the complaint allows. If you do not agree with the handling of the complaint, or the immediate investigation of the complaint is not possible, the Service Provider shall immediately draw up a record of the complaint and its position thereon, and

(i) in the case of an oral complaint communicated in person, hand over a copy thereof to you on the spot,

The Service Provider shall communicate this number to you. The Service Provider is obliged to examine the written complaint within thirty days of its receipt, to respond to it on the merits and to ensure that the response reaches you. If the Service Provider rejects the complaint, it shall state the reasons for its position in its substantive response.

10.11. If you wish to assert a claim not exceeding HUF 200,000 (two hundred thousand forints) in the proceedings of the conciliation board competent according to your place of residence (or stay), its validity does not depend on the Service Provider making a declaration of submission to the conciliation board.
